Defining Premise Liability
Before getting into the laws involving premise liability, it is important to understand what premise liability is. Premise liability refers to situations where a person is injured due to unsafe conditions on another person’s property. The owner of the land or property that has dangerous circumstances can be held liable for the injured party’s injuries if they should have known that the space was unsafe. However, premise liability cases can only be pursued if the injuries were caused by the property owner’s negligence, i.e. the property not been properly maintained.

What Makes A Premise Liability Case Viable?

But not only that, there must be evidence that the dangerous conditions were caused by improper maintenance and the property owner’s negligence. However, if a person is injured on someone else’s property but their injuries were not due to the property’s conditions, there is not a viable premise liability case to be had. Their injuries must be directly linked to a problem with the premises. Also, while property owners are required to keep their premises safe and clean, certain states have different laws that affect a property owner’s duty of care when a premise liability lawsuit is levied against them.
In some states, personal injury claims can only be made against property owners by invitees (individuals who are guests on the property, such as shoppers in a store) and licensees (people who are visiting the property with the consent of the owner, such as vendors or business partners) but not by trespassers (people who are on the property without the owner’s permission). I would absolutely recommend them to anyone who is suffering after an accident like mine. I was driving eastbound on Highway 193, a four-lane highway in Layton, Utah. I came to a stop at the two-way intersection of Highway 193 and North Hills Drive. The other driver failed to yield to my right-of-way and proceeded southbound through the intersection, I wasn’t able to stop fast enough, and I T-boned the other vehicle at a high speed. In January of 2014, my husband was involved in a terrible accident. He was driving on highway 89 in Wellsville, UT, when another driver ran a stop sign and pulled out in front of him.
