Tort
A tort is a civil wrong committed against an individual that resulted in injury or damages to their well-being and life. They Can differ from criminal wrongs because they focus on harm done to the individual which is between people, while criminal cases focus on harm done to society which involves a branch of the government. By law, individuals have protected interests which they can seek financial compensation for through the legal system if they are breached. While torts can overlap with crimes, in the majority of cases, tort law is designed to provide relief for those who have suffered injury and losses as a result of infringement on their protected interests.
The Three Categories Of Torts
Torts are divided into three general categories: intentional, negligent, and strict liability.
Intentional
Intentional torts are when a party purposefully commits an act that they know will cause injury or damages to another, such as punching someone in a fight or slandering them. While it may seem as though intentional torts should be classified as criminal cases as opposed to civil, intentional torts refer to actions that injure or damage someone’s property or well-being. Criminal actions are those which interfere with or damage the interests of society as a whole. It is possible for an intentional harm to be both a tort and a crime, however, victims typically recover more damages from civil cases as opposed to criminal ones.
Types of intentional torts include:
- Assault
- Battery
- Fraud
- Infliction of emotional distress
- Trespassing
- Defamation
- False imprisonment
- Conversion
- Invasion of privacy
Negligence
Negligence is the most common type of tort, by far. While intentional torts involve deliberate intent to engage in an action to hurt or damage another, negligent torts occur when one party fails to act in a reasonable manner and another person is hurt as a result of their actions. These refer to actions such as car accidents resulting from failure to follow traffic laws, slips and falls from a failure to maintain one’s property and put up signage warning of unsafe conditions, and more.
Types of negligence torts include:
- Auto accidents
- Truck accidents
- Slip and fall accidents
- Medical malpractice
- Motorcycle accidents
- Bicycle accidents
- Pedestrian accidents
Strict Liability
Strict liability torts apply to cases where injury is imposed with proof of intent or negligence. Even if the defendant took proper precautions and did not intend to cause harm, they can still be held liable for the injury of another. These kinds of torts refer to cases such as defective products and dog bites, where the fact that someone did not mean to cause injury and took appropriate levels of care is not a factor in determining liability.
Types of strict liability torts include:
- Abnormally dangerous activities
- Animal attacks
- Defective products
What You Need To Know About Tort Law
Tort law is complex, but it’s meant to hold people accountable for their actions that result in the harm of another and to ensure that those who suffer injury and losses as a result are able to recover damages.
The Benefits Of Tort Law
- Compensation for damages: ensures that the plaintiff recovers damages for losses suffered as a result of the tort.
- Disclosure of wrongdoing: illuminate wrongdoings that otherwise may not have been public knowledge which helps prevent future injury.
- Deterrence from future wrongdoing: Being held liable deters the defendant from continuing to behave in a way that results in injury of others.
If you’ve been victim to this law, having an experienced attorney in your corner will ensure that you receive the compensation you deserve for the losses you suffered as a result of your injury. In order to obtain compensation, it must be proven that the defendant failed their duty, that said failure is what caused your injury and losses, and that if they had not done so, you would not have been injured.
This law is complex, and too often, victims who attempt to represent themselves either fail to recover the damages they are owed or are not able to obtain a fair settlement. Insurance companies will utilize whatever tactics necessary in order to avoid paying you what you deserve and give you as low a settlement as possible.
