I was driving westbound on Highway 193 in Clearfield Utah, when I came to the intersection of 1000 East and Highway 193. I noticed that a firetruck was travelling east towards the intersection with its emergency lights on, all traffic around me, including myself, slowed to a stop to allow the firetruck an unimpeded path to travel. However, I noticed the Jeep behind me wasn’t slowing down. There wasn’t anything I could do to avoid the collision, so I just braced for impact. LeBaron & Jensen did a great job for me, kept me informed throughout the process, and helped make sure that I got the compensation I needed. I would absolutely recommend them to anyone who is suffering after an accident like mine. I was driving eastbound on Highway 193, a four-lane highway in Layton, Utah. I came to a stop at the two-way intersection of Highway 193 and North Hills Drive. The other driver failed to yield to my right-of-way and proceeded southbound through the intersection, I wasn’t able to stop fast enough, and I T-boned the other vehicle at a high speed. The impact of the crash was so severe that it triggered my vehicle’s airbags. The severity of the crash caused many serious and extensive injuries to my neck, back, shoulders, and head. In January of 2014, my husband was involved in a terrible accident. He was driving on highway 89 in Wellsville, UT, when another driver ran a stop sign and pulled out in front of him. He tried to swerve out of the way, but he wasn’t able to avoid hitting the other vehicle. Potential Strategies the Defense May Use
Since insurance companies are rarely eager to pay their obligated amounts to assist the victims after a personal injury, there are some common strategies they like to use as a defense to such claims, including:
- Intimidation– This is the most common strategy utilized by insurance companies to avoid paying their share of the damages. When victims file their personal injury claim without the help of an attorney, insurance companies have a reputation of creating outrageous defenses as to why it was the victim’s fault the accident occured. For an example, during a slip and fall case, the insurance of the business where the fall occurred may claim that the victim was not paying attention and was therefore injured due to their own negligence rather than theirs.
- Deny the Claim– The insurance companies may also deny the victims claim altogether and say that they didn’t pay their premiums or regular payments. Just because they tell the victims they are not obligated to pay them anything, doesn’t mean it’s true. When the victim is unrepresented they will most likely give up not knowing how to fight against a false denial. A benefit of hiring an attorney to assist you with your case is that they do know how to call bluff and fight back.
- Low Offers– One of the favorite strategies shared by the insurance industry is offering very low settlements to the victims before they find themselves an attorney to represent them. These offers are usually accompanied by a contract they trick the victims into signing when they agree to the low offer preventing them from another settlement for the same accident.
- Expert Opinions– The insurance companies may also get statements and false facts to make your claim look ridiculous by hiring experts that work for the insurance company. They usually use this strategy when the case makes it to court.
- Discounted Rates– Another common strategy insurers use to avoid compensating for claims is minimally discounting the victims rates for the insurance as a substitute for paying for the claim itself. Victims who do not seek an attorney are usually fooled with this strategy and end up missing out on most of their fair compensation amount.
